The Competition is co-organized by the International Council for Film, Television and Audiovisual Communication (ICFT) and the 1st International Film Festival & Awards • Macau (IFFAM).
The CINEFANTASY International Short Film Screenwriting Competition 2016 are open to writers worldwide who are between eighteen (18) and thirty-six (36) years old at the time of entry. The Promotion is subject to all applicable international or national laws and regulations.
3. ENTRY CONDITIONS AND RELEASE
By entering, each participant agrees to comply with and be bound by these Rules and the decisions of the Organizer, which are binding and final in all matters relating to the Competition.
4. ENTRANT'S PERSONAL INFORMATION
Organizer recognizes that your privacy is very important. We know that providing personal information is an act of trust and we take that seriously. Your email address will not be taken from our site and added to bulk mailing lists. The only people who will have access to your personal information are the Organizer’s staff and you the subscriber. Organizer take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up-to-date. Your information is stored on secure servers. In addition, our employees and data processors are obliged to respect the confidentiality of any personal information held by agents. However, Organizer will not be held responsible for events arising from unauthorized access to your personal information. Please notify us immediately if there is any unauthorized use of your account by any other Internet user or any other breach of security. Organizer provides links to websites outside of our service. These linked sites are not under the control of the Organizer and we are not responsible for the conduct of websites linked to our website. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of their websites.
The Competition begins on September 1, 2016 at 12:00 am, Paris Time (“PST”) and ends at the end of the 1st International Film Festival & Awards • Macau (IFFAM) (December 8-13, 2016).
6. HOW TO COMPETE
Electronic submissions only. To enter the CINEFANTASY International Short Film Screenwriting Competition 2016, you must meet the Official Rules and Conditions. Organizer and sponsor are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations or entries, which will be disqualified. All print or electronic Entries are destroyed or deleted after the conclusion of the contest for privacy purposes.
As part of each Entry, you may submit one (1) Scenario for evaluation and consideration for the Prizes by the Organizer or its designee. The Scenario must be your original creative work, and you hereby warrant and represent that you are the sole and exclusive owner of all right, title and interest in and to the Scenario and/or have obtained prior written authorization or license to submit the Scenario from any and all third party rights holders therein. You are prohibited from submitting any Scenario that have previously been produced at any time, or are currently under option, and you warrant and represent that the Scenario has never been produced by anyone at any time and is not under option at time of entry.
8. WINNERS SELECTION
Organizer and jury will select five (5) Entries for the Final. The 5 Finalists will be selected from among the entrants. One (1) First Prize Winner and one (1) Runner-up will be selected amongst the Finalists. The five (5) Finalists will be contacted and invited (including journey and accommodation) to the 1 st International Film Festival & Awards·Macau (IFFAM) (December 8-13, 2016) for the winners selection.
9. VERIFICATION OF FINALISTS
The five (5) Finalists must continue to comply with all terms and conditions of these Rules, and winning is contingent upon fulfilling all requirements. The Finalists will be required to sign and return to Organizer, within five (5) days of the date notice is sent, an affidavit of eligibility and liability/publicity release (except where prohibited by law) in order to claim their participation to the Final. If a Finalist cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, the Finalist forfeits the Final. In the event that a Finalist is disqualified for any reason, Organizer may choose an alternate Finalist from among all remaining eligible Entries.
For all Prizes: Prize is non-transferable and no substitution will be made except as provided herein at the Organizer’s and Jury’s sole discretion.
Except where prohibited by law, participation in the Competition constitutes each Winner’s consent to Organizer’s use of Winners’ names, likenesses, photographs, and/or personal information for promotional purposes in any media, worldwide, without further payment or consideration.
12. REPRESENTATIONS AND WARRANTIES
You hereby warrant and represent the following:
- There are no threatened, pending or current claims, actions or lawsuits in connection with the Scenario and you agree to notify the ICFT immediately upon your notification of any such claims, actions or suits;
- You are submitting the Scenario voluntarily on a non-confidential basis;
- You are at least between eighteen (18) and thirty-six (36) year of age;
- You have the right, authority, and capacity to enter into this agreement, and you agree to abide and be bound the terms and conditions herein.
13. CHOICE OF LAW AND DISPUTE RESOLUTION
This agreement shall be deemed to have been entered into and shall be construed and enforced in accordance with the laws of France and as applied to contracts made. Any controversy, dispute or claim arising out of or related to the agreement or your participation in the Competition shall be settled by an arbitrator in France. The arbitrator shall be well acquainted
14. INTELLECTUAL PROPERTY RIGHTS
By accepting your Entry, including your submission of the Scenario, we in no way grant you any additional rights therein or otherwise expand the scope of your rights under applicable copyright laws. You are solely responsible for protecting your rights in the Scenario. You acknowledge and agree that the ICFT and/or any participating judges may be independently accessing or currently developing separate creative concepts and/or works which resemble the Scenario, or may be accessing or incorporating concepts, themes, formats, plot lines, or characters similar to those in the Scenario, and that you are not entitled to any compensation and have no rights of any kind with regards to that separate material. However, you retain all rights to the Scenario itself and any other creative materials submitted to the Competition.
As a condition of participation, you agree that Organizer shall have a perpetual, irrevocable, world-wide, royalty-free, transferable, sub-licensable right to make publicly available the Submission in connection with the operation, conduct, administration, and advertising and promotion of the Competition. You agree to sign any necessary documentation that may be required by Organizer or its designees to make use of the rights you granted above. You also understand and acknowledge that Organizer and/or other Competitors may have developed or commissioned materials similar or identical to your Submission and you waive any claims you may have resulting from any similarities to your Submission. Nothing in these Terms shall be construed as granting you any right or license under any intellectual property right of Organizer or in Organizer products and services.
15. INDEPENDENT CONTRACTORS
The relationship between you and ICFT is one of independent contractors. Neither party will represent that it has any authority to assume or create any obligation, express or implied, on behalf of the other party, or to represent the other party as agent, employee, or in any other capacity, except as specifically provided herein.
16. GENERAL CONDITIONS
Organizer reserves the right to cancel, suspend and/or modify the Competition, or any part of it, if any fraud, technical failures or any other factor beyond Organizer’s reasonable control impairs the integrity or proper functioning of the Competition as determined by Organizer in its sole discretion. Organizer reserves the right in its sole discretion to disqualify any individual when finding to be tampering with the Entry process or the rules of the Competition or to be acting in violation of these Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate rules of the Competition may be a violation of civil law, and, should such an attempt be made, Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law.
17. LIMITATIONS OF LIABILITY
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Competition; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Competition; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Competition or receipt or use or misuse of any Prize.
18. COMPETITION RESULTS
Competition results are posted publicly on the Competition website and related social networks. Winners will also be made public and permanently posted to the Competition website and related social networks.
